Privacy statement

According to article 13 of the D.Lgs. no. 196/2003, "Data Protection Code", Reply S.p.A. with registered office in Turin (Italy), Corso Francia 110, represented by its pro- tempore legal representantive, in its quality as Data Processor, informs the user that his/her personal data (the "Data") collected by means of (i) the registration and the access to the web site www.tamtamy.com (the "Site"), (ii) the supply of the services related to the access to the Site and the use of the web areas of the same Site, (iii) the request for information concerning the services provided by Reply S.p.A., (iv) the surfing on the Site through the so called system's "logs", will be processed by Reply S.p.A. for the following purposes:

• performing the activities necessary in order to enter into, manage and execute the contracts and services indicated in points (i) and (ii) above;
• for purposes strictly connected and/or necessary in order to fulfil the requests made, from time to time, by a user by means of the Site or by email or by another communication's mean and in order to allow the user to use services and contents of the Site;
• fulfilling duties provided by laws, regulations, European Community provisions as well as by orders of authorities empowered by the law or by vigilance and control bodies;
• sending newsletters and advertising material having as object the services provided by Reply S.p.A.; market research; economic and statistical analysis.

In relation to the above indicated purposes, the processing of the Data is carried out by means of manual, information and data transmission means, applying principles strictly related to the mentioned purposes and for the time necessary for the same and, in any case, in order to ensure the security and privacy of the Data by using appropriate procedures which avoid the risk of loss, unauthorized access, unlawful use and dissemination of the Data.

Reply S.p.A. informs that all registration forms contain both mandatory fields (indicated with an asterisk [*]) and non-mandatory fields.

To this regard, please be informed that the collection of the Data is mandatory in relation to the purposes listed in points 1), 2) and 3) above. As a consequence should the user choose not to fill in the mandatory fields then Reply S.p.A. may not be able to respond to user's request or activate user's option choices.

With reference to processing's purposes indicated in point 4) above, Reply S.p.A. will request, from time to time, the user to give his/her consent to the data processing by clicking on specific fields / buttons of the Site.

In order to provide some services and/or to carry out some activities, the processing of Data is carried out both directly by Reply S.p.A. and by external subjects in their quality as data controllers and/or persons in charge of the processing, or by third parties which will act as autonomous data processors and to which the Data are communicated in order to reach the above mentioned purposes.

Therefore, the Data can be communicated to other subjects and in particular:

• to the subjects, natural persons or legal entities, charged by Reply S.p.A. with the task of performing technical repairs, ordinary and exceptional maintenance, restoration and updating the Site;
• to Companies of the Group to which Reply S.p.A. belongs (controlling, controlled and connected, even indirectly, companies according to the law provisions in force);
• to the bank/s charged by Reply S.p.A. with the task of performing and managing on-line payments. Such subjects will process the Data as autonomous data processors.

An updated and complete list of the above mentioned subjects is kept at the registered office of Reply and made available to the user.

The Data will not be disseminated.

The Data could be stocked in server/databases owned by third parties and/or located outside the European Community territory. At this regard Reply S.p.A. informs that, upon the submission of his/her Data, the user will be requested to give his/her consent to the transfer of the same Data outside the European Community territory.

Reply S.p.A. does not consciously process Data given by minor than 18 years old people and, consequently, it is not liable for the false Data conferred by minor than 18 years old people. Should Reply S.p.A. acknowledge that the Data - duly modified - were given by a minor person, Reply S.p.A. will immediately cancel the Data already collected, with the consequent impossibility for the minor person to access the services rendered by Reply S.p.A..

When Reply S.p.A. transmits to third parties - over the Internet - highly confidential information (such as a credit card number), in order to provide the user with specific services, the same Reply S.p.A. protects such Data through the use of encryption, such as the Secure Socket Layer (SSL) protocol.

Finally Reply S.p.A. informs that according to article 7 D.Lgs. 196/2003 the user has the right to obtain from the data processor or the data controller confirmation as to whether or not his/her personal Data exist and communication of such data in intelligible form. The user will be also entitled to be informed about the source of the personal data, the purposes and methods of the processing; to obtain cancellation, anonymization or blocking of personal data unlawfully processed, updating, rectification or, where interested therein, integration of the data, to object, on legitimate grounds, to the processing of his/her personal data.

The possible requests according to article 7 of the D.Lgs. 196/2003 shall be addressed to the following address privacy@reply.it or sent by letter to Reply S.p.A., Corso Francia 110, Turin.

The user undertakes to update the Data in case of variation and to look, from time to time, this document, in order to know any possible modifications or amendments to this document mainly due to changes in law provisions.
